If you do not accept these terms, do not use this website. Please be aware that these Terms and Conditions may be subject to change without notice from time to time and we recommend that you read them each time you place an order with us. Whilst every effort is made to update the information contained on the website, www.myindianstore.eu,  neither the Website Owner nor any third party or data or content provider make any representations or warranties, whether express, implied in law or residual, as to the sequence, accuracy, completeness or reliability of information, opinions, research information, data and/or content contained on the website (including but not limited to any information which may be provided by any third party or data or content providers) ("information") and shall not be bound in any manner by any information contained on the website.
The Website Owner reserves the right at any time to change or discontinue without notice, any aspect or feature of this website. No information shall be construed as advice and information is offered for information purposes only and is not intended for trading purposes. You and your company rely on the information contained on this website at your own risk. If you find an error or omission at this site, please let us know. 
 

3. Placing an order/Contract to purchase  

By placing an order on this website, www.myindianstore.eu,  you are making an agreement to purchase goods. Please check your order prior to completing the checkout process. Upon receipt of your order we will email you an order confirmation including details of the products you have ordered. If we are unable to process your order for any reason we will advise you as soon as possible. We may be unable to accept your order in the following cases:
·      If we are not able to gain authorisation for your payment.
·      Where there have been errors in pricing or description of products.
·      If products are unavailable. 
 
Once your order has been processed we will then issue you dispatch confirmation. Acceptance of your order and the completion of the contract between you and My Indian Store will take place once the goods have been dispatched.
 
Please be aware that some of the goods sold through My Indian store may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18’s.
 

4. Availability of Goods  

Whilst every effort has been made to ensure that all graphical representations and descriptions of goods available from us correspond to the actual goods, we are not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different goods altogether.
 
Where appropriate, you may be required to select the required [size] [model] [colour] [number] [other features] of the goods that you are purchasing.
 
We do not represent or warrant that such goods will be available. Stock indications are not provided on our ’www.myindianstore.eu, website.
 
If the products that you have ordered on www.myindianstore.eu,  are unavailable/out of stock from our suppliers, we will either issue a refund or we will dispatch a substitute that is a very similar product but with slightly different packaging, weight, manufacturer or brand. In this instance the customer will be contacted appropriately and will have time to express their desired option.
 

5. Pricing Policy 

All pricing information on www.myindianstore.eu, is correct at the time of going online. We reserve the right to change our prices and alter or remove any special offers from time to time and as necessary.
 
In the event that prices are changed during the period between an order being placed for goods, processing that order and taking payment. You will be contacted prior to your order being processed with details of the new price and an option offered to cancel/amend your contract if you do not wish to pay the new price. 
 
The prices of products found on our website www.myindianstore.eu, are inclusive of VAT at the appropriate rate where applicable. If your delivery address is outside the Tallinn, Estonia, Europe, there may be import duties and taxes levied when the shipment reaches your country. Any such additional charges (e.g. transport etc.) must be paid by you. Customs policies and practices vary widely from country to country so we recommend that you contact your local customs office for information on policies in the country relevant to you.
 

6. Promotional Codes 

From time to time www.myindianstore.eu,  will tender promotions in various forms including but not limited to discounts, a sale, special offers, free delivery, multi buys. Please note that only one such promotion may be redeemed per transaction unless otherwise stated.

7. Payment Information  

My Indian Store uses secure payment systems operated by WorldPay and PayPal. Payment can be made using credit or debit cards or via your PayPal account. Payment will be debited and cleared from your account before your order is dispatched. You confirm that the payment method, credit, debit card or PayPal account that you use is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us we will not be liable to you for any delay or non-delivery. If we feel it necessary to carry out additional security checks, we will request proof of ID such as a driving licence or utility bill before accepting your order. 

8. Delivery of Goods 

My Indian Store uses only trusted courier companies to deliver its products globally. Notification of when your product has been dispatched will be emailed to you. The courier companies that are used to ship goods will vary depending on specifications of the particular order. To help avoid problems, please enter any additional delivery instructions for the courier in the box provided once you click the checkout button.
 
My Indian Store reserves the right to choose the appropriate delivery service method. Once the parcel has been dispatched, the customer may contact  the My Indian Store team to find out the delivery service being used.
 
My Indian Store also reserves the right that if the goods are perishable, temperature controlled products and are not accepted at the delivery address on first attempt, then we are not responsible for loss/damage of goods.

9.Couriers

Standard and Express orders for the Estonia and Worldwide that are of medium/large weight may be shipped by My Indian Store via other courier services that may include but are not limited to DHL, APC and others.
 
Deliveries may require a signature in some circumstances. If a signature is required and cannot be obtained they will attempt to deliver the order and obtain a signature from an alternative address close to the delivery address. If successful they will leave a card giving you the details of the address to which the order has been delivered.
  
You can track your order online using the information included in your dispatch confirmation email. If no tracking information is provided in the confirmation email, you may contact us to retrieve this.
 
To report Non-delivery of all Express orders, you must notify us in writing within 24 hours from the expected delivery date giving full details of the circumstances. Failure to notify us within the specified time may invalidate your claim.
 

10. Order Cancellation

You may cancel your order for any reason through “Your Account” on our website, by email or by phone providing your order has not been dispatched by us.
 
If your order has been dispatched, you will be required to return the order to us and you will be responsible for the cost. We suggest the use of a secure delivery method that requires a signature upon receipt and provides you with a proof of posting. You must notify us that you are returning the goods to us. Please note that no perishable food, health, beauty, damaged packing, opened or used items will be accepted for a return.
 
Upon receipt of the returned goods a refund, excluding the delivery charge, will be credited within 30 days to the facility used to place the order.
 
You will become the owner of the goods you have ordered once they have been delivered to you and they will be held at your own risk. You have a statutory duty to take reasonable care of goods whilst held in your possession and until such time as returned goods are received by us. Please ensure that any goods being returned are packaged appropriately. We will not be liable for any loss or destruction of goods, once delivered to you. None of these terms and conditions affects your statutory rights as a consumer.

11. Faulty Products

We take care to select and package your goods to ensure they arrive in good condition. If your product arrives in poor condition or is defective in any way, please contact us directly and we will advise the returns procedure. We require photographic proof of the defective product. You are responsible for ensuring the product is safely returned to us, we suggest that you use a secure delivery method that requires a signature upon receipt and provides you with a proof of posting. Please forward a copy of the receipt and we will be pleased to refund the cost of postage. Upon receiving photographs of the product that is defective or in poor condition, we will either issue a full refund or send out a replacement. This does not affect your statutory rights.

12. Damaged Goods

Before signing to accept your delivery we strongly recommend that you check your order as you will be signing to confirm all is in good condition. If the goods arrive damaged, you must notify us by email within 2 working days giving complete details of the situation.
Please note: even if the loss or damage is noted on the delivery/consignment note or electronic device you will still need to notify us and keep the goods and the packaging available for inspection by the courier. Failure to notify us within the specified time may invalidate your claim.

13. Returns

You may return goods within 30 days to IndianMart. You are responsible for ensuring the product is safely returned to us. We suggest that you use a secure delivery method that requires a signature upon receipt and provides you with a proof of posting. For all returns, except where the item is faulty/defective, you will be required to arrange and fund the return of the goods to us.
In order for us to deal with your return efficiently please enclose your full contact details and advise us whether you require a replacement, refund or an exchange. This does not affect your statutory rights. Return parcels should be addressed to:

14. Registration with My Indian Store

To register with www.myindianstore.eu  you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Each registration is for a single user only. We do not permit you to share your user name and password with any person nor with multiple users on a network.
Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you must contact us immediately. My Indian Store reserves the right to suspend or cancel your registration immediately at our reasonable discretion if you breach any of your obligations under these terms and conditions.

15. Public Areas and User Submissions

My Indian Store is not responsible for any material submitted to the public areas by you (which include recipes, bulletin boards, reviews, or any other public area found on the website. Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by the website owner.
